1. Services Provided

KLEINDESIGN, LLC provides website design, SEO, development, and digital consulting services. All work is customized for each client based on agreed-upon terms outlined in the project proposal or agreement.

2. Payment & Refund Policy

  • Full payment is required upfront before any project begins.

  • Due to the custom nature of our services, all sales are final—no refunds, cancellations, or chargebacks after work has commenced.

  • If a project is delayed or terminated due to the client’s failure to provide necessary materials or feedback, no refund will be issued.

  • Requests for additional features or revisions beyond the agreed scope will be billed separately at our standard hourly rate or per a new project proposal.

3. Project Timelines & Client Responsibilities

  • Estimated project timelines will be communicated at the start of the project.

  • Clients must provide all necessary content, images, approvals, and feedback within the deadlines specified in the project agreement.

  • If a client fails to provide required materials within 14 days, KLEINDESIGN, LLC reserves the right to:

    • Adjust the project timeline without penalty or liability.

    • Pause or terminate the project without a refund.

  • If the client delays the project by failing to complete revisions, provide approvals, or meet deadlines, KLEINDESIGN, LLC is not responsible for missed deadlines or associated costs.

4. Ownership & Intellectual Property

  • Upon full payment, clients own the final website design and content but may not resell, reproduce, or redistribute our work without written permission.

  • KLEINDESIGN, LLC retains the right to showcase completed projects in our portfolio, marketing materials, and case studies.

5. Website Hosting & Maintenance

  • If you subscribe to our maintenance plan, we will provide ongoing updates and support for the duration of your subscription.

  • KLEINDESIGN, LLC is not responsible for hosting-related issues, third-party service failures, cyberattacks, or security breaches beyond our control.

  • Clients are responsible for maintaining secure login credentials for their website and associated accounts.

6. Liability Disclaimer

  • KLEINDESIGN, LLC makes no guarantees regarding SEO rankings, website traffic, sales conversions, or lead generation, as these depend on external factors and ongoing client efforts.

  • We are not liable for:

    • Downtime, data loss, or revenue impact caused by third-party providers, hosting failures, or client modifications.

    • Client errors, unauthorized modifications, or third-party integrations affecting website functionality.

    • Business losses, reputational damages, or indirect financial impact resulting from website performance or marketing effectiveness.

7. Termination of Services

  • KLEINDESIGN, LLC reserves the right to refuse or terminate services if a client engages in:

    • Fraud, abuse, or unethical business practices.

    • Repeated failure to provide necessary information or approvals within reasonable timeframes.

    • Disrespectful, unprofessional, or unlawful conduct.

  • If services are terminated by KLEINDESIGN, LLC due to a client’s breach of these terms, no refund will be issued.

8. Dispute Resolution & Governing Law

  • These Terms & Conditions are governed by the laws of the State of Missouri.

  • Any disputes arising from this agreement shall first be resolved through mediation. If mediation fails, the parties agree to binding arbitration in Missouri in accordance with the rules of the American Arbitration Association (AAA).

  • The client agrees to indemnify and hold harmless KLEINDESIGN, LLC from any claims, damages, or legal expenses arising from a breach of these Terms & Conditions.
